By way of introduction, I am Mark S Hubert P.C., the patent and legal counsel for Bycycle Inc., which is a small C Corporation headquartered in Portland, Oregon and founded in 1998. This company has manufactured and sold thousands of the comfortable and healthful bicycle saddle alternative known as the BiSaddle®.
Its founder James Bombardier, narrowly survived being struck by a Chevy Avalanche while riding his bicycle in 2006. While he has regained much of his previous physical condition, he has ongoing limitations that hamper his ability to run his company. While his original plan was to personally continue company oversight and expand its marketing and sales, Mr. Bombardier's traumatic brain injury now prevents his involvement beyond a limited role. Simply stated, Bycycle Inc. and the Bisaddle® are not being done justice.
Double Pops® and BiSaddle® are federally registered trademarks that as embodiments of US Patent No. 6,209,954 have been manufactured and sold all over the world under since 1999. Today, the internet provides a stable sales base. Although gaining publicity through public favor, the BiSaddle® has caught the serious rider's eye in other ways. Mr. Bombardier and one of his satisfied customers were quoted in a 2002 Wall Street Journal article. The BiSaddle® was included in a series of government (NIOSH) studies related to male sexual dysfunction that resulted in a 2009 NIOSH Workplace Solution recommending the usage of no-nose saddles. As of March 2007, 54% of the San Antonio Police bike patrol were riding the BiSaddle®. Further, two bicycle police officers have written articles for the International Police Mountain Bike Newsletter. (One of these was referenced in the June, 2011 science section of the New York Times.) Currently, the University of Massachusetts Bicycle Racing Club are evaluating the BiSaddle®. Mr. Bombardier wishes to sell or license his patent and technology to a party that can take advantage of the strong foundation that he has established. Mr. Bombardier is currently the president of Bycycle Inc., owning 98% of the company. The company has no employees and a minimum inventory and fabrication equipment. What is for sale are the patent rights, the trademarks, the fabrication documents and of course Mr. Bombardier's technical expertise in educating the new owner/licensee in the manufacturing and sales of his BiSaddle®.
Due to Mr. Bombardier's condition, he has only sold 1400 of these units since his crash, including special orders for physical considerations. As one can see, this is extremely low in relation to the national recognition and positive customer feedback the BiSaddle® has received. There should be no question that any party wanting to seize a foothold in the nascent noseless saddle market could do well as either a licensee or assignee of the related patent, trademarks and company.
